(b) This Agreement shall be open for signature at Vienna until 31 December 1973. The Vienna Convention, concluded in Vienna in 1973 and amended in 1985, establishes a classification (the Vienna Classification) for marks consisting of pictorial elements or containing pictorial elements. 7. (a) The Headquarters Agreement with the country in whose territory the Organization has its registered office shall provide that country shall grant advances if the working capital fund is insufficient. The amount of such advances and the conditions under which they are granted shall be the subject of separate agreements between that country and the Organization. 8. The audit shall be carried out by one or more countries of the Special Union or by external auditors in accordance with the Financial Regulation. They shall be determined by the Assembly with their consent. (b) The Assembly shall meet in extraordinary session at the request of one quarter of the member countries of the Assembly, convened by the Director-General. 4. The International Bureau is requested to prepare the work of the Provisional Committee. (b) Decisions of the Committee of Experts shall require a simple majority of the countries represented and voting. 3. The right of dismissal provided for in this Article may not be exercised by any country before the expiry of a period of five years from the date on which it becomes a member of the Special Union. (c) The Director-General shall, on request, transmit to the Government of each country which has signed or acceded to this Agreement two copies of the classification of figurative elements in English or French, certified by him. 3. (a) The Director-General shall transmit two copies of the signed text of this Agreement, certified by him, to the Governments of the countries which have signed it and at the request of the Government of any other country. (c) The Director-General may, at the request of the Committee of Experts, invite representatives of other intergovernmental and international non-governmental organizations to participate in the deliberations of interest to them. The Convention is open to States Parties to the Paris Convention for the Protection of Industrial Property (1883).
Instruments of ratification or accession must be deposited with the Director General of WIPO. 4. For the purpose of determining its contribution in accordance with point (i) of paragraph 3, each country of the Special Union shall belong to the same category to which it belongs in the Paris Union for the Protection of Industrial Property and shall pay its annual contribution on the basis of the same number of units determined for that category in that Union. . (b) The budget of the Special Union shall comprise the income and expenditure of the Special Union, its contribution to the budget of the common expenses of the associations managed by the Organization and, where appropriate, the amount made available to the budget of the Conference of the Organization. (i) make changes and additions to the classification of image elements; (c) Any amendment adopted pursuant to subparagraph (a) shall be binding on all countries for which the amendment referred to in subparagraph (a) has entered into force. 4. The International Bureau shall carry out all other tasks entrusted to it. (c) The agenda for each meeting shall be drawn up by the Director-General. (2) The convening of a review conference shall be decided by the Assembly.
2. (a) Subject to Article 5, the Assembly shall proceed as follows: (iii) sale or royalties for publications of the International Bureau of the Special Union; 3. Ratification or accession shall automatically entail the acceptance of all clauses and the recognition of all the benefits of this Convention. 4. Paragraph 3 shall in no way be construed to mean that a country of the Special Union implicitly recognises or recognises the factual situation affecting a territory to which this Agreement is made applicable by another country under that paragraph. 4. The Committee of Experts shall adopt its rules of procedure. This provides for the possibility of participating in the meetings of the subcommittees and working groups of the Committee of Experts of the intergovernmental organizations referred to in paragraph 2 (b), which can contribute significantly to the elaboration of the classification of pictorial elements. 1. Proposals for amendments to Articles 7, 8 and 9 and to this Article may be submitted by any country of the Special Union or by the Director General. Such proposals shall be transmitted by the Director-General to the countries of the Special Union at least six months before their consideration by the Assembly.
2. Denunciation shall take effect one year after the date of receipt of the notification by the Director-General. 3. The budget of the Special Union shall be financed from the following sources: (vii) set up such committees and working groups as it deems appropriate for the achievement of the objectives of the Special Union; 1. Any country of the Special Union may denounce this Agreement by means of a notification addressed to the Director General. (iv) have the right to establish subcommittees and working groups. (ii) Instruct the International Bureau in the preparation of revision conferences; This Agreement shall have the same duration as the Paris Convention for the Protection of Industrial Property. (c) Contributions are due on the first of January of each year. The Vienna Agreement created a union that has an assembly. Every Member State of the Union shall be a member of the Assembly. One of the main tasks of the Assembly is the adoption of the Biennial Programme and Budget of the Union. (d) Subject to rule 11, paragraph 2, resolutions of the Assembly shall require two-thirds of the votes cast.
3. Article 24 of the Stockholm Act of the Paris Convention for the Protection of Industrial Property shall apply to this Agreement. 1. The classification of figurative elements shall include a list of the categories, subdivisions and sections in which the figurative elements of marks are classified, accompanied, where appropriate, by explanatory notes. 2. The Director-General and all the staff designated by him shall participate without the right to vote in all meetings of the Assembly, the Committee of Experts and other committees or working groups established by the Assembly or the Committee of Experts. The Director-General or an agent designated by him shall be the ex officio secretary of those bodies. (e) if the budget is not adopted before the beginning of a new financial year, it shall correspond to the budget of the preceding financial year as provided for in the Financial Regulation; (b) Any amendment to the articles so adopted shall be binding on all countries that are members of the Special Union on the date of entry into force of the Special Union, provided that any modification which increases the financial obligations of the countries of the Special Union shall be binding only on those countries which have notified their acceptance of such amendment. .
The Agreement also established a Committee of Experts on which all members of the Union are represented. The main task of the Committee is the regular revision of the classification. (b) The International Bureau may consult with intergovernmental and international non-governmental organizations in the preparation of revision conferences.
